Four Spanish Civil Guards, without informing the RGP and therefore outside the expected protocol between two police enforcement agencies of two different countries, entered Gibraltar's territorial waters and landed at Harbour Views waterfront. It was thanks to the many witnesses who informed the RGP, and the quick and efficient Royal Gibraltar Police immediate reaction and professionalism that the procedure only took a few minutes and the arrest took place quickly enough to avoid what could have been a very serious incident.

Spanish Guardia Civil incidence in Gibraltar

Four Spanish Guardia Civil officers from the maritime section at Algeciras were detained by the RGP together with 2 other Spanish nationals who were arrested on the evening of 7th December 2009 following a chase at sea which ended up within Gibraltar Territorial Waters. The RIB that was being pursued by the Guardia Civil grounded itself by the rocks at Harbour Views.

Enquiries established that the Guardia Civil mistakenly entered Gibraltar Territorial Waters in hot pursuit and have since apologised for their actions. The 4 Spanish officers have been released pending further enquiries and handed over to the custody of the Guardia Civil Command in Algeciras. The RGP though, have retained their RIB and firearms pending further enquiries.

The other two Spanish nationals who were subject of the chase are being investigated for the offences of importing a prohibited import [the RIB] .

Hot Pursuit

The two Spanish nationals arrested on the evening of 7th December 2009 by RGP officers after a hot pursuit involving the Guardia Civil have been jointly charged with one count of importing a prohibited import [the RIB].

The RIB which is classified as a 'fast launch' run aground on the rocks at Harbour Views after being pursued by a Guardia Civil vessel. Francisco Javier Otero Magdalena dob 22 07 69 of 148 carretera del Conde, Pontevedra, Galicia and Jose Antonio falcon Outeda dob 21 10 77 of calle Laasan, Isla de Rosa 7, Pontevedra, Galicia are jointly charged with importing into Gibraltar a fast launch, namely a semi-rigid vessel, with no registration number and fitted with an aggregate two hundred (200) or more brake horse power engine, namely three Yamaha 2500cc engines, the importation of which is prohibited under the Imports and Exports (Control) 1987 Regulations as amended by the Imports and Exports (Control) (Amendment) Regulations 1987. They have both appeared before the Magistrates Court.
